These Terms & Conditions (“Terms”) govern your use of bighornthreads.com (the “Site”) and the products and services offered by VP Promos LLC, doing business as Bighorn Threads (“Bighorn Threads,” “we,” “us,” or “our”). By using the Site or submitting a request to us, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

1. About Us

Bighorn Threads is a Las Vegas, Nevada custom-apparel and promotional-products shop providing screen printing, embroidery, branded workwear and safety apparel, company stores, and promotional products. “Bighorn Threads” is a registered fictitious-name (DBA) of VP Promos LLC.

2. Use of the Site

You may use the Site only for lawful purposes. You agree not to misuse the Site, interfere with its operation or security, attempt unauthorized access, scrape or harvest data except as permitted, or use it to send spam or unlawful content. We may suspend or restrict access at our discretion.

3. Quotes, Orders & Artwork

• Quotes are estimates. Prices quoted are based on the information you provide and current supplier pricing, and are not binding until we confirm a written order. Quantities, garment availability, decoration specs, and freight can change pricing.
• Order confirmation. An order is accepted only when we confirm it in writing (email is sufficient). Production timelines begin after artwork approval and, where applicable, receipt of payment or deposit.
• Artwork & proofs. You are responsible for reviewing and approving digital proofs. We are not responsible for errors (spelling, layout, color, sizing, placement) approved by you. Screen, print, and thread colors may vary from on-screen previews.
• Your content. By submitting logos, designs, text, or other materials, you represent that you own them or have all necessary rights, licenses, and permissions to use and reproduce them. You grant Bighorn Threads a non-exclusive, royalty-free license to copy, reproduce, modify (for fit/output reasons), display, and apply those materials to your ordered goods, and to use anonymized samples of finished work in our portfolio unless you tell us not to. You agree to indemnify us against claims arising from materials you supply.
• Production variances. Industry-standard over/under runs, minor placement and color variances, and supplier substitutions of comparable items may occur.

4. Intellectual Property

The Site and its content — text, graphics, logos, photographs, and layout — are owned by or licensed to Bighorn Threads and protected by intellectual-property laws. Product data and images are © SAGE® and the respective suppliers, used under license. You may not copy, reproduce, or republish Site content without our written permission. Brand names and trademarks referenced on the Site belong to their respective owners.

5. SMS / Text Messaging Program Terms

Bighorn Threads operates two separate text-messaging programs under our brand, each requiring its own explicit opt-in. You may opt in to either, both, or neither.

• Bighorn Threads Customer Care (non-marketing). Texts related to your quote, order, and account — quote follow-ups, artwork-proof updates, production and delivery status, appointment reminders, and replies to questions you send us. Estimated frequency: typically 2–6 messages per active order; frequency otherwise varies based on your activity with us.
• Bighorn Threads Promotions (marketing). Texts about special offers, discounts, new products, and seasonal promotions. Estimated frequency: up to 4 messages per month.
• How you opt in. You opt in by checking the corresponding SMS consent box on a form at bighornthreads.com (for example, on our contact / quote page or an event sign-up page), or by giving us your number with written consent at an in-person event. Each program requires a separate, affirmative check; consent is never pre-selected.
• Age requirement. You must be 18 years of age or older to use this SMS service.
• Consent is not a condition of purchase. You are not required to opt in to text messages to request a quote, place an order, or otherwise do business with us.
• Opt out (STOP) instructions. You may opt out of either SMS program at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message from that program. We will send one confirmation text and then stop sending you that program’s messages. Opting out of one program does not opt you out of the other; opting out of marketing texts does not stop transactional texts about an active order, and vice versa. • Carrier liability. Carriers are not liable for delayed or undelivered messages.
• Rates & frequency. As always, message and data rates may apply for messages sent to you from us and to us from you. For questions about your text plan or data plan, contact your wireless provider.
• Privacy. Mobile information is used only to communicate with you about the program you opted in to. For more, see our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

6. Disclaimers

The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. Product availability and pricing are subject to change without notice.

7. Limitation of Liability

To the fullest extent permitted by law, Bighorn Threads and VP Promos LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the Site or our services. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

8. Indemnification

You agree to indemnify and hold harmless Bighorn Threads, VP Promos LLC, and their owners and employees from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your breach of these Terms, or materials or instructions you provide to us.

9. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to their jurisdiction.

10. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above reflects the most recent change. Your continued use of the Site after changes take effect means you accept the updated Terms.
